These general terms and conditions of sale (hereinafter referred to as the "GTC") govern sales concluded on the JAGWA website between the company JAGWA France and any person making a purchase through the site.

Their purpose is to define the conditions of ordering, payment, delivery, return, as well as the respective rights and obligations of the parties within the framework of the distance sale of products offered by JAGWA.

1. Seller's identity

2. Scope

These General Terms and Conditions apply to all sales concluded on the JAGWA website, with individual and professional clients, subject to any specific provisions agreed in writing between the parties.

Placing an order on the website implies full and complete acceptance of these Terms and Conditions by the customer, to the exclusion of any other document.

3. products

The products offered for sale are those appearing on the site on the day of consultation, within the limits of available stock.

JAGWA takes great care in the presentation and description of its products so that the customer can know their essential characteristics before placing any order.

Photographs, visuals, texts, descriptions, usage instructions, and rendering indications are provided as accurately as possible. However, slight differences may exist, particularly due to the display, production, application, or storage conditions of the product.

4. Price

The prices displayed on the website are in euros, inclusive of all taxes, unless otherwise stated.

Delivery charges vary and are specified to the customer before final order confirmation.

For orders shipped outside of France or the European Union, customs duties, local taxes, import fees, or clearance fees may be levied by the authorities of the destination country. These charges are the sole responsibility of the customer.

Professional rates

JAGWA may offer, after validation, specific pricing conditions to professional clients.

Creating a professional account does not automatically grant access to professional rates. Activation of these rates is subject to prior approval by JAGWA.

Professional discounts and rates apply only to orders placed after validation of the professional account, when the customer is logged into their account at the time of the order.

No professional discount can be applied retroactively to an order already validated, paid or invoiced before the activation of the professional account.

5. order

The customer selects the products they wish to purchase, adds them to their cart, and follows the online ordering process.

Before final validation, the customer can check the details of their order, its total price and correct any errors.

The sale is considered final only after payment has been validated and an order confirmation email has been sent.

JAGWA reserves the right to refuse or cancel any order in the event of a prior dispute with the customer, non-payment, suspicion of fraud, manifestly erroneous information, or impossibility of executing the order under normal conditions.

6. Payment

Payment is due immediately upon ordering.

Payment can be made by credit card or through secure payment solutions offered on the site, including Stripe, PayPal, Klarna, Link or any other solution displayed at the time of payment.

In the event of a refusal of payment authorization, incomplete payment or payment incident, the order may be suspended or cancelled automatically.

7. Shipping and Delivery

Orders are generally prepared and shipped within an estimated timeframe of 24 hours, excluding Sundays, subject to payment validation, product availability and absence of exceptional circumstances.

Shipments are made every day except Sunday.

Deliveries can be made in France and internationally, subject to acceptance of the package by the customs services or authorities of the destination country.

The delivery times indicated on the website or by the carrier are estimates only. They may vary depending on the carrier, the country of destination, customs formalities, periods of high demand, or any external event beyond JAGWA's control.

JAGWA cannot be held responsible for delays caused by the carrier, customs services, or force majeure. However, in the event of a proven delivery problem, JAGWA will make every effort to assist the customer in tracking the package and finding a suitable solution.

8. Receipt of order

It is the customer's responsibility to check the condition of the package and products upon delivery.

In the event of any apparent anomaly, damaged package, missing product or damaged product, the customer is invited to make any necessary reservations with the carrier and to contact JAGWA as soon as possible, attaching if possible photographs and any information useful for processing their request.

This early reporting makes it easier to process the case and find a suitable solution.

9. Right to retract

When acting as a consumer, the customer generally benefits from a legal period of fourteen (14) days from the receipt of the products to exercise his right of withdrawal, without having to justify his decision.

However, in accordance with applicable legal provisions, this right of withdrawal cannot be exercised, in particular, for:

  • goods made to the customer's specifications or clearly personalized, including custom carbon stencils ;
  • goods that are liable to deteriorate or expire rapidly, including jagua juice, the jagua gels and, more generally, the kits containing these products.

For other products that may be eligible for the right of withdrawal, the customer must notify their decision in writing before the expiry of the legal period, then return the complete, unused products in their original condition, at their own expense, to the return address indicated in Article 11.

10. Returns outside the right of withdrawal

Apart from the applicable legal grounds for withdrawal, no returns will be accepted without prior agreement from JAGWA.

In the event of a return accepted for commercial purposes, the products must be returned complete, clean, properly packaged, and in a condition allowing for their inspection.

Unless the error is attributable to JAGWA or a legal guarantee applies, return shipping costs remain the responsibility of the customer.

12. Lost, damaged, undelivered or unclaimed parcels

In the event of a lost parcel, impossible delivery, recognized damage or proven malfunction of the delivery attributable to the carrier, JAGWA may, depending on the situation and subject to the necessary checks, offer either a reshipment of the product(s) concerned, or a refund.

When a package cannot be delivered or handed over to the customer for a reason attributable to the customer, in particular in the case of an incorrect or incomplete address, absence during delivery attempts, failure to collect within the allotted time or refusal of the package, the financial consequences of this situation remain the responsibility of the customer.

If the package is returned to JAGWA, it will be examined upon receipt.

Given the perishable and sensitive nature of the products sold, JAGWA reserves the right, depending on the condition of the returned products:

  • to offer reshipment at the customer's expense;
  • to proceed with a partial refund;
  • or to refuse any refund if the products can no longer be resold under normal conditions of quality or safety.

In the event of a refund, the initial delivery costs, any return costs charged to JAGWA, as well as any depreciation of the products, may be deducted from the refunded amount.

No refund can be issued until the package has actually been returned to JAGWA.

The choice of the most suitable solution will be assessed on a case-by-case basis, depending on the nature of the problem, the availability of products, logistical constraints and the information provided by the carrier.

13. Storage and responsibility for use

Jagua-based products are sensitive products that require appropriate storage conditions.

Unless otherwise indicated on the product or its instructions, Jagua must be kept in the freezer in order to preserve its qualities.

JAGWA cannot be held responsible for any alteration of the product, a decrease in performance, or an unsatisfactory result arising in particular from:

  • poor storage after delivery;
  • failure to follow the instructions for use;
  • of use unsuitable for the skin type, application area or support;
  • from professional or personal use that does not comply with normal precautions for use.

It is the customer's responsibility to verify before use that the product is suitable for the intended use and to comply with the storage, handling and application instructions.

14. Legal guarantees

For sales concluded with consumers, the products benefit from the applicable legal guarantees, including the legal guarantee of conformity and the guarantee against hidden defects, under the conditions provided for by law.

JAGWA is responsible for defects of conformity existing at the time of delivery of the goods and appearing within the applicable legal period.

When applicable, the legal guarantee of conformity allows the consumer to obtain the conformity of the goods, according to the terms provided for by the applicable laws.

All claims under legal guarantees must be addressed to contact@jagwa.frspecifying the order reference, the product concerned and the nature of the problem observed.

15. Intellectual Property

All elements present on the JAGWA website, including texts, visuals, photographs, videos, logos, graphics, illustrations, layouts, trade names, trademarks, and all other content, are protected by intellectual property law.

Unless prior written authorization is obtained, any reproduction, representation, adaptation, distribution, exploitation or use, even partial, of these elements is strictly prohibited.

16. Personal data

The personal data collected during the ordering process is processed in accordance with the website's privacy policy. Customers are encouraged to review this policy to understand the purposes of the processing, the recipients of the data, and their rights.

17. force majeure

JAGWA shall not be held liable for the non-performance or delay in the performance of its obligations when it results from an event constituting force majeure or any circumstance reasonably beyond its control, including interruption of transport, customs blockage, natural disaster, epidemic, failure of a service provider or exceptional unavailability of raw materials.

19. Consumer mediation

In the event of a dispute that remains unresolved after a prior written complaint to JAGWA, the consumer client may resort to a consumer mediator under the conditions provided for by the Consumer Code.

20. Applicable law and competent jurisdiction

These T & Cs are subject to French law.

In the event of a dispute, and failing an amicable resolution, the French courts will have jurisdiction, subject to the mandatory rules applicable to consumers.
