General conditions of sale

Condition of use

The Jagwa France® online shop was implemented by the Jagwa France® company, which is the operator of this site. Making order in respect of a product appearing within the web site online store jagwa.fr requires prior consultation of these general conditions. Accordingly, the consumer acknowledges being perfectly informed that his agreement on the contents of these general conditions does not require the handwritten signature of this document, insofar as the customer wishes to order online the products presented in the shop of the web site. The consumer has the option to save or edit these terms, provided that both the backup edition of this document are the sole responsibility. The online store set up by society Jagwa® as part of the website includes the following information:

Legal notice identifying specific society Jagwa France®;

Presentation of the essential characteristics of the goods proposed;

Indication in euros of the price of the goods, as well as delivery charges;

Indication of the terms of payment and delivery;

The existence of a right of withdrawal;

The period of validity of the offer or the price in case of promotion;

All these information are presented in French. The consumer declares having full legal capacity allowing him to engage in the title of the present general conditions.

Section 1: full

The present general conditions express the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept without reserve all of the provisions laid down in these conditions General. No general or specific condition contained in documents sent or handed over by the consumer can integrate herein, since these documents would be incompatible with these general conditions.

Article 2: object

These terms are intended to define the rights and obligations of the parties under the sale of goods and services offered by the Jagwa® company to the consumer.

Article 3: Contractual Documents

This contract is formed by the following contractual documents, presented in descending hierarchical order: the General conditions; the purchase order. In case of contradiction between the provisions contained in the documents of different row, the provisions of the above document will prevail.

Article 4: Entry into force – duration

The present general conditions come into force on the date of signature of the order form. The present general conditions are concluded for the duration necessary for the provision of the goods and subscribed services, until the extinction of the guarantees due by the company Jagwa France®.

Article 5: Electronic Signature

The "click" of the consumer in respect of the purchase order constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.

Article 6: Order Confirmation

The order will be confirmed by email once the payment has been made.

Article 7: Proof of the transaction

Records computerized, stored in the computer systems of the Jagwa® company in reasonable conditions of safety, will be considered as proof of communications, orders and the payments occurred between the parts. The archiving of order forms and invoices is made on a reliable and durable support that can be produced as evidence.

Article 8: Information about products

8-a: the Jagwa France® company presents on its web site the products to sell with the necessary features that allow to comply with Article L 111-1 of the consumer Code, which provides for the possibility for the potential consumer of knowing before taking final order the essential characteristics of the products they wish to buy.

8-b: the offers presented by the JagwaFrance® company are valid only within the limit of stocks available.

Article 9: price

Prices are indicated in euros and are valid on the date of sending the purchase order by the consumer. They do not account delivery costs, invoiced in supplement, and indicated before the validation of the order. The prices include the VAT applicable on the day of the order and any change in the VAT rate will be reflected in the price of the products in the online store. The payment of the full price must be made when ordering. At no time, payments may be considered as deposits or prepayments.

Article 10: Mode of payment

To set the order, the consumer has, at his option, all of the payment methods specified in the purchase order. The consumer guarantees Jagwa France® has the permissions necessary to use the method of payment chosen by him, during the validation of the purchase order. The Jagwa France® company reserves the right to suspend any management of order and any delivery in the event of refusal of authorization of payment by bank card on behalf of the officially accredited or in the event of non-payment organizations. The Jagwa France® company notably reserves the right to refuse to make a delivery or to honor an order from a consumer who would have not solved completely a previous order or with whom a dispute is under administration.

Article 11: Availability of products

The order will be processed at the latest within a period of 3 days from the day following that where the consumer placed his order. In case of unavailability of the ordered product, including the fact of our suppliers, the consumer shall be informed at the earliest and will have the possibility to cancel his order. The consumer will then have the choice to ask either the reimbursement of the sums paid within 30 days at the latest of their payment, or the exchange of the product.

Article 12: Delivery arrangements


The products are delivered to the address indicated by the consumer on the order form. The consumer is required to check the State of the packing of the goods upon delivery and report damage to the carrier on the delivery, as well as the Jagwa France® company, within a period of one week. The consumer may, at his request, obtain sending an invoice to the billing address and not the delivery address by validating the option provided for this purpose on the purchase order. As regards shipping, work us primarily with Colissimo Suivi. As soon as we proceed to a sending, you receive immediately an email you informing. Parcels are deposited mailed from Monday to Thursday, in order to guarantee the freshness of our product, this one to keep cool, and avoid remains the weekend in local unrefrigerated post.

THE POST OFFICE

To minimize transportation costs, all products of small or medium size are shipped by a service of the post Colissimo Suivi. Apart from the fact to be economic, this service delivers in 2-3 days in the France and offers the possibility of recovering the products ordered at your post office close to the delivery address if there is no initial on the place of delivery during the presentation of the factor. Specifically, if you are absent the day of delivery, your factor will leave you a notice in your Inbox mailbox, allowing you to collect your parcel at your post office during opening hours, within a period of 15 days. Colissimo Suivi is a very reliable service. However, it may be, as in any expedition, that there may be a delay in delivery or that the product goes astray. In case of delay of delivery terms we have recommended to you in the email for shipping, we ask you to report us this delay by calling us by phone or by sending us an email. We will then contact the post office to start an investigation. A post investigation can last up to 21 days from the date of commencement of the investigation. If during this period, the product is found, it will be immediately forwarded to your home (the majority of cases). If however the product is not found at the end of the period of 21 days of investigation, the post Office considers the parcel as lost. It is only at this time that we can return you a replacement product, at our expense. If the ordered products were not available at this time, we will refund the amount of products affected by the loss of the carrier. If the products were still available, but had changed selling prices on the site, we would apply the new sale price, either by paying by check for the difference, or by requesting a check for this price difference. We disclaim all responsibility for the lengthening of delivery because of the carrier, particularly in the case of loss of products or strike.

Article 13: Problems of delivery because of the carrier

Any anomaly concerning the delivery (damage, product missing compared to the delivery order, damaged parcel, broken… products) will have to be imperatively indicated on delivery in the form of "handwritten reserves", accompanied by the signature of the client. The consumer must at the same time confirm this anomaly by addressing to the carrier within two working days following the delivery date a mail recommended with acknowledgement Exhibitor such claims. Article 14: Errors of delivery

14-a: the consumer should make to society Jagwa France® no later than the first day following the delivery, any complaint of error of delivery and/or nonconformity of the products in kind or in quality compared to the indications on the order form. Any complaint formulated beyond this deadline will be rejected.

14-b: the formulation of this claim with the company Jagwa France®, can be made: – in priority by e-mail to contact@jagwa.fr – by logging on our site in the heading "contact", "where, after entering your order number, you can ask us your question through the site.

14-c: any claim not made in the rules defined above and within the deadlines will not be taken into account and will release company Jagwa France® from any liability towards the consumer.

14-d: on receipt of the claim, society Jagwa France® will award a number of exchange of the product (s) (s) concerned and will communicate by e-mail or telephone to the consumer.

14-e: in case of error of delivery or Exchange, any product exchange or refund must be returned to the company Jagwa France®, as a whole and in its packing of origin, in Colissimo recommended, to the following address:

To be accepted, any return will have to be reported in advance to the Customer Service of the company Jagwa France®.

Shipping costs are the responsibility of the Jagwa® company, except in the case where it would appear that the returned product does not correspond to the declaration of origin made by the consumer in the good of return.

Article 15: Guarantee of products

Pursuant to Article 4 of Decree n ° 78-464 of 24 March 1978, the provisions of herein cannot deprive the consumer of the legal guarantee which requires the seller to guarantee against all consequences latent of the thing sold. The consumer is specifically informed that the Jagwa France® company is not the producer of the products presented in the website, in the sense of the law n ° 98-389 of 19 May 1998 and relating to the responsibility of the fact of defective products. Consequently, for damage caused to a person or a good by a defect of the product, only the responsibility of the producer of it may be sought by the consumer, on the basis of the information contained on the product said package. Article 16: Right of withdrawal

The consumer has a period of 10 working days to return, at its own expense, the products not agreeing to him. This period runs from the day of delivery of the order of the consumer. If this period expires on a Saturday, a Sunday or a public holiday, it is extended until the first following working day. All returns must be reported as a preliminary near the Customer Service of the company Jagwa France® by logging on our site in the heading "contact". Only be taken up products returned in their entirety, in their original packaging complete and intact, and in a perfect state of resale. Any product which has been damaged, or whose original packaging is damaged will be neither refunded nor exchanged.

This right of retractation is exerted without penalty, except for the expenses of return. In the event of the exercise of the right of withdrawal, the consumer has the choice to ask either the refunding of the sums paid, or the exchange of the product. In the case of an Exchange, the return will be at the expense of the consumer.

In case of exercise of the right of withdrawal, the company Jagwa France® will make all efforts to refund the consumer within 15 days. However, given the technical nature of the products sold, this period may be extended to 30 days, in particular when the product needs a technical checking (cf products to be tested beforehand).

The consumer will then be refunded by re-credit of his bank account (secured transaction) in case of payment by credit card or by cheque in the other cases.

Article 17: Rights of use

The right of use of the drawings and original stencils of society Jagwa France®, as well as those distributed by it, is granted to the consumer as a non-exclusive, personal and non-transferable, in accordance with the Code of intellectual property.

Article 18: Force majeure

None of the two parties will have failed in its contractual obligations, to the extent where their execution will be delayed, hindered or prevented by a fortuitous event or force majeure. Will be regarded as unforeseeable circumstances or force majeure any fact or circumstance compelling, exterior to the parties, unpredictable, unpreventable, independent of the will of the parties and which cannot be prevented by them, despite all the efforts reasonably possible. The party affected by such circumstances as shall notify the other within ten working days of the date on which it has become aware. The two parties then, closer in a period of a month, except impossibility due to the force majeure, to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued. If the force majeure lasting more than three months, the present general conditions may be terminated by the injured party. Expressly, are considered as cases of force majeure or fortuitous, in addition to those usually retained by the jurisprudence of the courts and french courts: the blocking of the means of transport or supplies, earthquakes, fires, storms, floods, lightning; the judgment of the telecommunication networks or difficulties specific to external telecommunication networks to customers.

Article 19: Not partial validation

If one or more stipulations of these general conditions are held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent court, the other stipulations will keep all their force and scope.

Article 20: Not renunciation

The fact that one of the parties to not rely on one breach by the other party to a any obligations stipulated in these general conditions cannot be interpreted for the future as a renunciation of the obligation in question.

Article 21: title

In case of difficulty of interpretation between any titles contained in head clauses, and one any clauses, the titles will be declared non-existent.

Article 22: Applicable law

The present general conditions are subject to French law. It is for the rules of Fund and the rules of form. In case of dispute or claim, the consumer will address the Jagwa France® company to seek an amicable solution.

Section 23: Information technology and freedom

The information that is requested from the consumer is necessary for the processing of his order and may be communicated to the contractual partners of the Jagwa France® company, involved in the execution of this command. The consumer may write to the company Jagwa®, whose coordinates are within the privacy policy contained within the web site, to oppose such a communication, or to exercise his rights of access, rectification for information about it and from the files of the company Jagwa France®, in accordance with the law of January 6, 1978.
